This Privacy Policy is designed to help you understand how Portal, Inc. (“Portal” or “we” or “Service” or “Portal Platform”) collects, uses, maintains and discloses information collected from users (“You” or “you” or “User” or “Users”) of its www.portalup.co Platform and any derivative or affiliated Sites on which this Privacy Policy is posted (collectively, the “Platform”). This Privacy Policy is not a contract and does not create any legal rights. Providing your information is voluntary and your use of the Service (defined below) after the effective date of this document constitutes your acceptance of this Privacy Policy. If you do not agree to all the terms and conditions of this Privacy Policy, do not use the Service.

We collect the information you give us, the information you choose to give us and information that is necessary for use of payment services, your account, Classes/Sessions you open and/or Item(s) that you post
Use of Information
We use, store, and process information, including personal information, about you to provide, understand, improve, and develop the Portal Platform, create and maintain a trusted and safer environment and comply with our legal obligations.
We may use your Personal Information to:
- Enable you to access and use the Portal Platform.
- Enable you to communicate with other Users.
- Operate, protect, improve, and optimize the Portal Platform and experience, such as by performing analytics and conducting research.
- Provide customer service.
- Send you service or support messages, updates, security alerts, and account notifications.
- Provide you with and personalize our products and services, including storing transcripts of, and content provided during, Tutor Driver sessions or online Classes, creating an account for you, and enrolling you in free trials (if applicable).
- Maintain our internal records and otherwise manage our business
- Send you newsletters, notices and offers and otherwise correspond with you about products, services, companies and events that we think might interest you
- Perform research and analysis about your use of or interest in our products and services or the products or services offered by others
- Develop and display content and advertising tailored to your interests on our Platform and other sites, and provide our advertisements to you when you visit other sites
- Enforce our terms, policies, guidelines, and agreements.
- Perform functions as otherwise described to you at the time of collection.
- To provide you access to our Services and Customer Support by means of e-mail or telephone
- To prevent, detect and investigate potentially prohibited or illegal activities, fraud and security breaches and to enforce our Terms of Use
- To contact you, by e-mail, push notification, text message (SMS) or by telephone, to inquire about our Services for the purpose of targeted marketing activities, updates, and promotional offers based on your message preferences (where applicable), or for any other purposes as set forth in this Privacy Policy
- To provide you with other services that you have requested, as described when we collected the information.
- Sharing information with and registration on social media sites: We may offer sign-on Services that enable you to access the Platform or related websites with your login credentials. We can also offer Services that enable you to share information with third party social media websites, such as Facebook and Google.
- Enable you to access and use our designated Payment Processors.
- Detect and prevent fraud, abuse, security incidents, and other harmful activity.
- Conduct security investigations and risk assessments.
- Conduct checks against databases and other information sources.
- Comply with legal obligations (such as anti-money laundering regulations).
- Enforce our terms, guidelines, agreements and policies.
- With your consent, send you promotional messages, marketing, advertising, and other information that may be of interest to you based on your preferences.
- The Payments Data Controller processes this information given its legitimate interest in improving our designated Payment Processors and its Users’ experience with it, and where it is necessary for the adequate performance of the contract with you and to comply with applicable laws.
Marketing Purposes
- We will process your personal information for the purposes listed in this section given our legitimate interest in undertaking marketing activities to offer you products or services that may be of your interest.
- You agree that we may use the information collected by us to send you offers, whether personalized or not, or to contact you by telephone regarding products and/or Services offered by Portal.
- We will not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our Services and functionalities.
- When you no longer wish to receive marketing communications from us, you can follow the unsubscribe link in the marketing communication you received.
Basic Account Information
- You don’t have to create an account to use some of our service features, such as searching and viewing public Tutor, Owner, Seller, Trader, Tutor Driver profiles or selling Items. If you do choose to create an account, you must provide us with some personal data so that we can provide our Services to you. On Portal this includes a display name, a username, a password, phone number and an email address. Your display name, profile picture and username are always public, but you can use either your real name or a pseudonym as your username. You must use your real name in the “First Name” and “Last Name” entry sections for the display name.
- For Tutors, Tutor Drivers, Owners, Sellers, and Traders, your Meet Places will also be displayed publicly.
- For Students, their names and any documents that it shared with Tutors and Tutor Drivers will be shared with them.
- We collect your financial information (like your bank account or credit card information) when you use our designated Payment Processors to process payments.
Public Information
- Most activity on Portal is public, including your profile information at times your location when you created your account, and your posts and certain information about your posts like the date, time, and application and version of Portal you posted from. The lists you create, people you follow and who follow you, and posts you Like, or share are also public. Groups that are created and/or you have joined are also public. Group Messages are public to all Members of that particular group. Reviews and ratings are all public. You are responsible for your posts and other information you provide through our Services, and you should think carefully about what you make public, especially if it is sensitive information.
- Parts of your public profile page, such as your name, your description, and city, are publicly visible to others.
- Classes, Sessions and Items are publicly visible and include the location of the Meet Place which will be displayed on a Google Map Display, your public profile photo, and any additional information you choose to share.
- Your Item(s) that you are currently selling or have been sold, rented or traded will be public
- After completing a rent or buy, you may write Reviews. Reviews and Ratings are a part of your public profile page and may also be surfaced elsewhere on the Portal Platform (such as the Listing page).
- For Tutors and Tutor Drivers, Classes, Closed Classes your name, and credentials will be displayed publicly.
- For Students, their names and any documents that it shared with Tutors and/or Tutor Drivers will be shared with them.
- Groups you have joined.
- Users’ online and offline status.
Tutor Profile/Bios
- We display tutor’s information that is used to sign up such as name, grade, credentials, Classes, Closed Classes, profile picture, Class time, time zone, online or offline status, location, and reviews.

Your control of your information
- What information your posts will contain
- Whether to put your bio or profile picture on Portal
- Whether to posts Items to sell, rent and/or trade
- Whether to let Sellers, Owners, and/or Traders know your personal information
- Whether to let possible Students or Users know your credentials or status
Information Sharing
- Sharing with Portal. Even if your Country of Residence is not the United States, your information may be shared with Portal which provides the technical infrastructure for the Portal Platform, product development and maintenance, customer support, trust and safety and other operation services Portal provides.
- Some of the data that is shared with Portal may be used for legal purposes.
- Sharing with Portal’s designated 3rd party Payment Processors. In order to facilitate payments on or through the Portal Platform, certain information as described, may be shared with the designated 3rd party Payment Processor.
Location Information
- Information of location will be displayed publicly on Tutor and Tutor Driver profiles (after applying and being accepted) and Item postings.
- Information you share through posts or messages or to other Users or in bios.
Messages
- You may send private messages to Users using the Portalssages or the message button displayed in their profile or postings or Group Messages.
Non-Personal Information
- We share or disclose non-personal data, such as aggregated information like the total number of times people engaged with a post, or reports about how many joined a Class, or Group Members or reviews.
Updating, correcting, accessing or removing personal information
- You can correct, access or delete your personal information by clicking edit in your bio, Item information or Class information.
Deletion
- We keep your information after deletion for up to a year.
- Keep in mind that search engines and other third parties may still retain copies of your public information, like your profile information, Classes, Sessions, Profile Items and public posts, even after you have deleted the information from our Services or deactivated your account.
Cookies
- A cookie is a small piece of data that is stored on your computer or mobile device. Like many websites, we use cookies and similar technologies to collect additional website usage data, identify a User, to operate our Services. And to make Portal better for you.
- Cookies are not required for many parts of our services such as searching and looking at public profiles. Although most web browsers automatically accept cookies, many browsers’ settings can be set to decline cookies or alert you when a website is attempting to place a cookie on your computer. However, some of our Services may not function properly if you disable cookies.
- When your browser or device allows it, we use cookies to better understand how you interact with our Services, to monitor aggregate usage patterns, and to personalize and otherwise operate our Services such as by providing account security, personalizing the content we show you, and remembering your language preferences. We do not support the Do Not Track browser option.

- We use Google Analytics to track Users time on Portal, the time stamp, their city, and the pages visited.

Legal Disclaimer
- Portal and Portal Payments may disclose your information, including personal information, to courts, law enforcement or governmental authorities, or authorized third parties, if and to the extent we are required or permitted to do so by law or if such disclosure is reasonably necessary: to comply with our legal obligations, to comply with legal process and to respond to claims asserted against Portal, to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our Users to legal liability, to enforce and administer our Terms of Use & Services or other agreements with Users, or to protect the rights, property or personal safety of Portal, its employees, its Users, or members of the public.
- These disclosures may be necessary to comply with our legal obligations, for the protection of your or another person's vital interests or for the purposes of our or a third party’s legitimate interest in keeping the Portal Platform secure, preventing harm or crime, enforcing or defending legal rights, or preventing damage.
- Where appropriate, we may notify Users about legal requests unless: providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon Portal’s property, its Users and the Portal Platform. In instances where we comply with legal requests without notice for these reasons, we will attempt to notify that User about the request after the fact where appropriate and where we determine in good faith that we are no longer prevented from doing so.
- However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your personal data.
Privacy & Updates
Children Privacy
For any User under the age of 18, we must have permission from such User’s parent or legal guardian before we collect or use any Personal Information of such User on the Platform. You are welcome to call us at (770) 250-4435 to review any Personal Information we have collected from a User under 18. You may request that we delete this information or specify that we collect no more of your child’s information. We will need to verify the identity of anyone requesting information about a child under the age of 18 to ensure that the person is in fact the child’s parent or legal guardian.
Your California Privacy Rights
California law permits Members who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those third parties. Contact us at privacy@Portalup.co to send such requests. Portal and Portal Payments do not share personal information with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your personal information to third parties for their direct marketing purposes by withholding consent.
Your Choices
You may review, update, or delete the information in your Portal Account by logging into your Portal Account and reviewing your Account settings and profile or contacting us.
Changes to this policy
We may revise this Privacy Policy from time to time. The most current version of the policy will govern our processing of your personal data and will always be at https://www.portalup.co/privacy-policy. If we make a change to this policy that, in our sole discretion, is material, we will notify you by email to the email address associated with your account. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
