DMCA Policy
In using Portal, you are deemed to have read and agreed to the DMCA Policy.
The Digital Millennium Copyright Act (the “DMCA”) (17 U.S.C. §512 et. al., as amended), relates to the online service providers, like Portal, being asked to remove material that allegedly violates someone’s copyright. Since we respect content owner rights, it is Portal’s policy to respond to alleged infringement notices that comply with the Digital Millennium Copyright Act of 1998 (“DMCA”). We reserve the right to delete or disable Content alleged to be infringing, and to terminate the accounts of repeat alleged infringers.
Notification of Infringement
If you believe in good faith that materials available on Portal infringe your copyright, you or your agent may send to Portal a written notice by mail, e-mail or fax, requesting that Portal remove such material or block access to it. If you believe in good faith that someone has wrongly filed a notice of copyright infringement against you, the DMCA permits you to send to Portal a counter-notice. Notices and counter-notices must meet the then-current statutory requirements imposed by the DMCA. See http://www.copyright.gov/ for details. Notices and counter-notices must be sent in writing to our DMCA Agent as follows: By mail to Portal DMCA Agent, 303 Perimeter Center N #300, Atlanta, GA 30346; by e-mail to legal@portalup.co; or by phone number to (770) 250-4435.
The following information must be communicated to Portal:
- Your physical or electronic signature;
- An identification of the material that was removed and the location at which the material appeared before it was removed. Providing a URL (or providing a time when a tutor class occurred if applicable) at which you believe there has been an infringement is the best way to help us locate content quickly;
- Your contact information, including at a minimum your mailing address, telephone number, and email address; and the following written out:
- I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- The information in the notification is accurate, and under penalty of perjury, I am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
PLEASE NOTE THAT UNDER SECTION 512(F) OF THE DMCA, ANY PERSON WHO KNOWINGLY MATERIALLY MISREPRESENTS THAT MATERIAL OR ACTIVITY IS INFRINGING MAY BE SUBJECT TO LIABILITY.
Counter-Notification
If you believe that a DMCA Notice has been submitted in error, and that your posting was not infringing, you may contact our DMCA Agent at the contact information provided above to submit a written counter-notification. Under the DMCA, a counter-notice must include the following information:
- Your physical or electronic signature;
- An identification of the material that was removed and the location at which the material appeared before it was removed. Providing a URL (or providing a time when a tutor class occurred if applicable) at which you believe there has been an infringement is the best way to help us locate content quickly;
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification of the material (whether or not it was intentional);
- Your contact information, including at a minimum your mailing address, telephone number, and email address; and
- A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Portal may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
